TERMS OF SERVICE

The following terms establish an agreement between you, the user, and Expert TA, LLC. Access to our website and the services provided therein are contingent upon your acceptance of the terms in this agreement. If you do not agree with or do not agree to adhere to the terms in this agreement, you should not register for our service. Expert TA may change the Terms of Service from time to time. At the time these changes are made, Expert TA will make available the updated Terms of Service on our website and will include the new terms in the registration process. By accepting these terms, you understand and agree that your use of Expert TA after the date on which these Terms of Service have changed constitutes acceptance of the updated Terms of Service. If you do not agree with any updated terms or do not agree to adhere to updated terms, you may cancel your access.

Expert TA provides educational software that performs online grading of tutorials and homework where both student grades and information are involved. Our company understands the sensitivity of this information and we are committed to protecting the privacy of its users. This privacy statement provides an overview of the terms and conditions surrounding the use of our system.
Expert TA is a secure site. All actions and transmissions including the login process and completion of material to be graded are encrypted using SSL. You will notice the URLs throughout Expert TA’s website are ‘https’ rather than standard unsecure/unencrypted ‘http’ connections. Security certificates can be viewed for each page of our web application.

Expert TA will not in any way violate the privacy rights of any student/user as defined in the Family Educational Rights and Privacy Act (FERPA). This act (20 U.S.C. 1232g; 34 CFR Part 99) is a Federal law that protects the privacy of student education records. The privacy act can be read in full at: http://www2.ed.gov/policy/gen/guid/fpco/ferpa/index.html. In accordance with British Columbia’s Freedom of Information and Protection of Privacy Act (‘FIPPA’), Section 30.1(a).

Expert TA will maintain detailed student work for a period of two years, and student grade data for a period of six years. Records of detailed work (example: individual submitted answers, accessed hints, etc.) are kept for the benefit of any student who takes a follow-on course. Consider a student taking Physics II, after having taken Physics I. Such a student may benefit from referencing their work from a previous semester/year. Occasionally students will take such a follow-on course several semesters after the first course in a sequence.

Expert TA requires individual user consent in order for personal information to be stored on servers within the United States. By agreeing with these ‘Terms of Service’ such consent is provided, allowing Expert TA to securely store student information, including information pertaining to student grades, in order to facilitate and fulfill Expert TA’s primary function as an online homework service. Expert TA will not sell, or in any way disclose, any user information (student, instructor, institution, or otherwise) to any third party. The singular purpose of this information in the system is for educational and instructional use. For Expert TA to ultimately produce a grade-sheet view where students’ grades are presented to an instructor, this information (students names, emails, grades, etc.) must be stored in our database. Expert TA stores information about student grades in such a way that no unauthorized users can access the data. Furthermore, each student is assigned a GUID or Globally Unique Identifier and grades are stored with this unique number rather than any recognizable information such as name or email.

Expert TA administrators and programmers may analyze data for such purposes as monitoring and improving system performance or functionality, to analyze data or activity in order to perform system enhancements, or to analyze data for the purposes of anonymous education research in order to improve understanding of student learning, but will not see student information and grades together during the course of regular monitoring and maintenance. Expert TA has tools that allow us to perform analytics and diagnostic calculations both system-wide, and for individual classes. When system-wide analysis is done, individual student information is never visible. When analysis is done for an individual class, student names are only visible in the form of the reports being provided to the instructor for that class. Expert TA administrators will not view individual student data unless requested by the instructor or student. Expert TA support administrators do have the ability to log into both student and instructor accounts in order to help troubleshoot problems and provide customer support.

In addition to grade data, Expert TA has the ability to access detailed logs that show actions and time stamps of student users. When there are questions about academic misconduct, an instructor may request detailed log data for any student(s) in his or her own class. This log data may only be requested by and supplied to the ‘instructor of record’ for the course, and may not be requested by student users. Expert TA employees will not view individual grade data for students, outside of direct requests made by class instructor or by the individual student, or as allowed by any other terms in this agreement. Grade data may be requested by either the ‘instructor of record’ for the course and a student user may request his or her own grade data.

“Right to be forgotten” requests will be honored and processed for only when the request is made by the individual who owns the account and associated data, or has power of attorney for such user. When a user is enrolled in an active class, or was in an active class within a period of six months of the request to be forgotten, Expert TA must first notify and obtain consent of the “instructor of record” for the course. Once we process this “right to be forgotten” request, you will no longer have access to any of the Expert TA products or services that you have had in the past or currently have. Once processed any and all previously purchased products would need to be repurchased in order to regain access to those products or services. Once complete, this process is permanent and irrevocable. Expert TA may change the Terms of Service from time to time. At the time these changes are made, Expert TA will make available the updated Terms of Service on our website and will include the new terms in the registration process. By accepting these terms, you understand and agree that your use of Expert TA after the date on which these Terms of Service have changed constitutes acceptance of the updated Terms of Service.
